
The moment of uncertainty that we are currently experiencing due to covid-19, has led the Government to extend the deadline for the preparation of holiday maps, a measure that applies to the private and public sector. Employers and workers now have until May 15 to schedule the 2021 holidays.
This decision is contained in the diploma that extends several deadlines and configures exceptional and temporary measures due to the pandemic.
According to the Labour Code, the employer must draw up the holiday map indicating the beginning and end of each employee's holiday periods and post it in the workplaces. With the Decree-Law 22-A/2021 , both the approval and the posting of the respective holiday map "can take place until May 15".
According to the law, workers are entitled to 22 days of annual leave (in the civil service one day is added for every ten years of service and in collective agreements they can provide for more). If there is no agreement, it is the employer who must schedule the vacation, following several rules and ensuring that they cannot start on the worker's weekly rest day.
In small, medium and large companies, the employer can only schedule holidays between 1 May and 31 October, unless the collective labour regulation instruments or the opinion of the workers' representatives accept different deadlines.
In tourism-related activities, if there is no agreement, the employer is obliged to mark a quarter of the period to which workers are entitled (taken consecutively), or with a higher percentage resulting from the collective labour regulation instrument (between 1 May and 31 October).
If spouses or people living in a de facto union or common economy work in the company, the law determines that they are entitled to take holidays in the same period, "unless there is serious damage to the company".
The law gives permission that if there are days left in a year, these days can be taken until April 30 of the following year.
